This is working as designed. As described in the Phase 2 tooltip, the Overlord is 'phased' whenever on an AI bastion world and cannot be attacked at that time. The unit 'appears' once it enters a planet that is not a Bastion world and can be attacked at that point. This happened in the attached save, it moved to McKinney and then Okmulgee; as that was the first non-Bastion world it reached, that was the point at which it became vulnerable.
